These terms are an agreement between you and Drivzz ("Drivzz", "we") for using the Drivzz app and website. Please read them with our privacy policy and refund and cancellation policy, which are part of these terms. If you don't agree, please don't use Drivzz.
1. About Drivzz
Drivzz is an online marketplace. It lets car owners ("owners") list their cars and lets people ("renters") book them, self-driven, with the owner's driver or with a chauffeur. Drivzz provides the platform: listings, identity checks, booking, the online payment, messaging, trip records and support.
Drivzz is an intermediary under the Information Technology Act, 2000. Drivzz does not own, operate or rent out the cars listed, does not employ the drivers or chauffeurs, and is not a party to the rental agreement. When a booking is confirmed, the rental agreement is between the renter and the owner, on the terms shown in the booking and in these terms.
2. Who can use Drivzz
- You must be at least 18 years old and able to make a binding contract under Indian law.
- To book a self-drive trip you must hold a valid Indian driving licence for that class of vehicle (or another licence valid for driving in India), and only you, or another driver named and verified in the booking, may drive.
- You may have only one account, and you must not use Drivzz if we have suspended or closed your account before.
3. Your account and KYC
- You sign in with your mobile number. Keep access to it secure; you are responsible for activity on your account.
- You agree to complete identity verification (KYC) when asked, and to give true, current documents: an Aadhaar card (the masked Aadhaar is accepted) and, for self-drive, a driving licence. Owners also give vehicle documents and payout details.
- We may refuse, pause or remove verification if a document looks invalid, expired, altered or not yours, and ask for a new one when a document expires.
- Keep your details up to date. Verification by Drivzz is a check of the documents provided; it is not a guarantee of anyone's conduct.
4. Owners and listings
If you list a car, you confirm and agree that:
- you are the registered owner, or have the registered owner's written consent recorded through Drivzz, and the right to rent the car out;
- the car has a valid registration certificate, insurance policy and PUC certificate, and any permit or registration the law requires for the way you list it (for example under the Motor Vehicles Act, 1988 and your state's rules for rent-a-cab or self-drive rentals). Making sure this is in place is your responsibility;
- the car is roadworthy, clean, serviced and safe, and matches its photos and description;
- any driver or chauffeur you provide holds a valid licence (and badge, where required), is fit to drive and is engaged by you, not by Drivzz;
- your prices, included km, extra charges, deposit, pickup fees and cancellation policy are as shown in the listing, and you won't ask a renter for more than the booking shows, except charges allowed at return (extra km, extra days, approved tolls, and agreed damage);
- you will honour bookings you accept. Repeated cancellations by an owner can lead to lower visibility, fees or suspension.
We may review, edit for format, pause or remove listings that break these terms or the law.
5. Bookings
- A renter sends a request for dates and a mode (self-drive, owner's driver, chauffeur). The owner can accept or decline. A booking is confirmed when the owner has accepted and the renter has paid the booking amount in the app.
- The price for the booking (rent, extras, platform fee, deposit if any) is worked out by Drivzz and shown before you pay. That price is fixed for the booking, even if the owner later changes the listing.
- Extensions must be requested and accepted in the app. Late returns without an accepted extension may be charged at the extra-day rate and can affect your account.
6. Fees and payments
- Renters pay a platform fee of 2% of the trip subtotal (rent plus any driver, chauffeur, night-halt and pickup charges), shown as a separate line.
- Owners pay either a commission of 5% of the base rent of each booking, or a flat monthly plan of ₹999 with no per-booking commission. Commission is not charged on driver charges, pickup fees or deposits. Commission on amounts the renter pays the owner directly is recorded as dues in the owner's Drivzz account and must be paid as shown in the app.
- Fees may change in future; any change applies only to bookings made after it is announced in the app. Taxes such as GST are added where applicable.
- Payments in the app are processed by Cashfree Payments, an RBI-authorised payment aggregator, by UPI, card, net banking or other methods it offers. Cashfree's terms apply to the payment itself. Drivzz does not store card numbers or UPI PINs.
- Where the booking allows it, the balance can be paid to the owner directly by cash or UPI. Ask for a receipt. Drivzz can only refund money that was paid through the app.
- Owner payouts for amounts paid in the app are made to the bank account or UPI ID on the owner's account after the trip is completed, less commission and any amounts due.
7. During the trip
- At handover and return, renter and owner record photos of the car, odometer and fuel in the app. These records are used to settle questions about damage, fuel and km.
- The renter must drive lawfully and carefully, carry their licence, wear seatbelts, and not drive under the influence of alcohol or drugs.
- The car may only be used for personal travel. No sub-renting, carrying passengers or goods for hire, racing, towing, off-road driving, driving training, or taking the car outside the area allowed in the booking.
- Return the car on time, at the agreed place, in the same condition (fair wear and tear excepted) and with the fuel level noted at pickup, unless the booking says otherwise.
- The app shares the car's location during an active trip as described in the privacy policy.
8. Damage, accidents, breakdowns and fines
- In an accident or breakdown, make everyone safe first, inform the police where the law requires, and tell the owner and Drivzz from the trip screen straight away. Don't arrange repairs yourself unless the owner agrees.
- The renter is responsible for damage to the car, loss of the car or its parts, and the owner's reasonable costs, caused during the trip, except fair wear and tear and damage covered and paid by the car's insurance. Where a deposit was taken, agreed amounts may be deducted from it.
- The renter is responsible for traffic challans, tolls, parking and other fines incurred during the trip, including those that arrive after the trip ends. Drivzz may share the renter's details with the owner and the authorities for this.
- Disputes should be raised in the app within 7 days of the trip ending. Drivzz will look at the trip records and both sides' evidence and may propose a settlement. For amounts paid through the app and deposits, Drivzz can adjust payouts and refunds to give effect to a decision; beyond that, Drivzz helps but cannot force a payment.
- Insurance: Drivzz is not an insurer and does not sell insurance. Cover depends on the owner's own policy. Owners are responsible for having a policy that suits how they list their car.
9. Cancellations and refunds
Cancellations, no-shows, deposits and refunds follow our refund and cancellation policy and the cancellation policy shown on the car when you booked.
10. Rules everyone follows
- Don't give false information, impersonate anyone, or upload documents that aren't yours.
- Don't take bookings or payments outside Drivzz for people you met on Drivzz to avoid fees. Trips agreed outside the app are not covered by Drivzz support, refunds or dispute help.
- Don't harass, threaten or discriminate against anyone, or post unlawful, abusive or misleading content.
- Don't misuse the service: no scraping, automated access, reverse engineering, attacks on our systems, or attempts to get around limits or checks.
11. Your content and ratings
You keep ownership of photos, reviews and other content you add. You give Drivzz a non-exclusive, royalty-free licence to host, show and adapt it to run and promote Drivzz while it stays on the platform. Reviews must be honest and about a real trip. We may remove content that breaks these terms.
12. Suspension and closing your account
- You can pause (deactivate) or delete your account at any time from Settings in the app, once no booking is open and no refund is pending. See deleting your account.
- We may limit, suspend or close an account, pause listings or cancel bookings if we reasonably believe someone has broken these terms or the law, or to protect people's safety. Where we can, we tell you why and give you a chance to respond. If we cancel a confirmed booking for reasons that are not the renter's fault, the renter gets a full refund.
- We may change, pause or stop parts of the service, for example for maintenance. We'll try to give notice of significant changes.
13. Liability
- Drivzz provides the platform "as is". We work hard to keep it available and accurate, but we don't promise it will always be uninterrupted or error-free, and we don't guarantee the condition of any car or the conduct of any user.
- To the extent the law allows, Drivzz is not liable for indirect or consequential loss, or for loss arising from the rental itself, the car, or the acts of owners, renters, drivers or third parties. Drivzz's total liability to you for any claim is limited to the fees you paid to Drivzz for the booking concerned, or ₹5,000 if no booking is concerned.
- Nothing in these terms limits liability that cannot be limited under Indian law, or your rights under the Consumer Protection Act, 2019.
- You agree to compensate Drivzz for losses and reasonable costs caused by your breach of these terms or the law.
14. Law and disputes
These terms are governed by the laws of India. Please contact us first so we can try to resolve any complaint quickly. If it can't be resolved, the courts of India with jurisdiction will decide, and you may also approach the consumer commissions under the Consumer Protection Act, 2019.
We may update these terms. We'll show the new date at the top and, for important changes, tell you in the app before they take effect. Continuing to use Drivzz after that means you accept the updated terms.
